Trump Axes Crucial ACA Cost-Sharing Subsidies

Schneiderman to Trump on Obamacare cuts: “See you in court”

NY Attorney General Will Sue Trump To Protect Healthcare Subsidies For The Poor

NY will join California, Massachusetts and a dozen other states in suing the Trump administration for eliminating the Affordable Care Act's cost-sharing reductions, Attorney General Eric Schneiderman said Friday afternoon.

The attorney generals filing the lawsuit represent California, Kentucky, Massachusetts, Connecticut, Delaware, Maryland, Oregon, North Carolina, Illinois, New York, Vermont, Pennsylvania, Rhode Island, Virginia, Minnesota, New Mexico, Washington, Iowa, and the District of Columbia. "That's unacceptable", Schneiderman, the attorney general said. "It's past time President Trump learned he doesn't get to pick and choose which laws he'll follow and which bills he'll pay".

Becerra said it's unclear what will happen to a pending challenge to the Obamacare subsidies filed by House Republicans. Cost-sharing subsidies under Obamacare help lower consumer out-of-pocket health care costs.

States' attorneys general are lining up to sue the federal government to continue making cost sharing reduction payments to insurers, which President Trump Thursday evening indicated that he would be suspending.

"The subsidy is really a subsidy to the insurance company", Trump told reporters Friday. "Piece by piece we will now begin the process of giving America the great Health Care it deserves!"

The House sued the Obama administration, arguing the White House was illegally funding cost-sharing reduction subsidies payments to insurers.

"Having failed to persuade a Republican Congress to repeal the Affordable Care Act (ACA), President Trump now appears to be trying to accomplish by executive fiat what he could not through Congress - treating New Yorkers as political pawns in his effort to sabotage the health care market".

Harris called the action "devastating".

"In the meantime, my office will continue to defend the vital ACA subsidies in federal court for the hundreds of thousands of New Yorkers and millions of Americans who rely on the quality, affordable health care they provide".

Health care providers say removing the subsidies will hurt lower- and middle-income people. If Trump is successful, insurance premiums could increase 15 to 20 percent, Becerra estimated.
