NY will join California, Massachusetts and a dozen other states in suing the Trump administration for eliminating the Affordable Care Act's cost-sharing reductions, Attorney General Eric Schneiderman said Friday afternoon.
The attorney generals filing the lawsuit represent California, Kentucky, Massachusetts, Connecticut, Delaware, Maryland, Oregon, North Carolina, Illinois, New York, Vermont, Pennsylvania, Rhode Island, Virginia, Minnesota, New Mexico, Washington, Iowa, and the District of Columbia. "That's unacceptable", Schneiderman, the attorney general said. "It's past time President Trump learned he doesn't get to pick and choose which laws he'll follow and which bills he'll pay".
Becerra said it's unclear what will happen to a pending challenge to the Obamacare subsidies filed by House Republicans. Cost-sharing subsidies under Obamacare help lower consumer out-of-pocket health care costs.
States' attorneys general are lining up to sue the federal government to continue making cost sharing reduction payments to insurers, which President Trump Thursday evening indicated that he would be suspending.
"The subsidy is really a subsidy to the insurance company", Trump told reporters Friday. "Piece by piece we will now begin the process of giving America the great Health Care it deserves!"
The House sued the Obama administration, arguing the White House was illegally funding cost-sharing reduction subsidies payments to insurers.
