Reuben Foster will not participate in 49ers team activities until his domestic violence case is over. More

According to local prosecutors, Foster's 28-year-old girlfriend had to flag down a passing auto after he threw her out of his Los Gatos house.

Police arrested Foster in February on allegations of domestic violence, and the Santa Clara County District Attorney's Office announced Thursday it was bringing charges, including felony domestic violence, against him. The second-year linebacker out of Alabama, a first-round pick by San Francisco last year, could face more than 11 years in prison if convicted on all counts.

Here's the latest statement: "Rueben Foster will not participate in team activities as he is tending to his legal matters". He is scheduled to meet with the team this week, a sitdown that could determine his future with the franchise.

Foster also has a case pending in Alabama for his misdemeanor marijuana possession arrest in January. A blanket statement from the team described Thursday's charges as "disturbing" and that Foster "is aware that his place in our organization is under great scrutiny". If convicted of all charges, Foster could go to prison for almost a decade.

In addition to the criminal charges, Foster is subject to potential NFL discipline under the league's personal conduct policy, which mandates a six-game suspension for a first-time domestic violence offense.

Investigators said the alleged assault by Foster left his live-in girlfriend bruised and with a ruptured ear drum.

Foster was arraigned last week and ordered to have no contact with the woman involved in the case while remaining free on $75,000 bond. On Sunday, CEO Jed York, coach Kyle Shanahan and general manager John Lynch released a joint statement announcing that Foster will not join his teammates for a voluntary nine-week offseason program that began Monday.

As a result, it was up to the 49ers as to whether he would participate in any offseason workouts. In a statement, the 49ers organizations said: "We will continue to follow this serious matter".

After Foster was charged last week, the Niners issued a statement saying they meant to follow the matter and noted that Foster "is aware that his place in our organization is under great scrutiny and will depend on what is learned through the legal process". "We don't condone this kind of behavior and certainly we'd not like to see any of our players have any kind of issues or the victims to suffer any at all".
